Realismo Trágico: ¿Cómo regular los deepfakes en Colombia?

Resumen
Los recientes avances tecnológicos en inteligencia artificial y machine learning han permitido crear vídeos falsos que parecen auténticos. Estos vídeos denominados “DeepFakes”, al dejar pocos rastros de manipulación, tienen el potencial de alterar las elecciones, de una manera más sofisticada que la desinformación digital. La desinformación digital repercutió en el plebiscito sobre los acuerdos de paz de Colombia de 2016. Este artículo explora la manera en que otras jurisdicciones han respondido al surgimiento de deepfakes para evaluar a partir de un enfoque de análisis del impacto de la reglamentación tres alternativas regulatorias– mantener la regulación inalterada, hacer responsable a las redes sociales por su contenido y tipificar la producción y distribución de los deepfakes–. Se concluye que a pesar de ser la criminalización de los deepfakes la alternativa que mejor podría alcanzar los fines regulatorios, su aplicación podría también representar una amenaza para la libre expresión y la democracia.
