Between Legal Theory and the Discourse of Rights: Prepaid Health Plansin Light of the Constitutional Court’s Rulings

Abstract

This article presents a jurisprudential analysis of tutela rulings issued by the Constitutional Court between 2019 and 2024 in cases involving disputes between prepaid medical service providers and users. Through a systematic examination of these decisions, we synthesize the cases and the dogmatic rules established by the Court. We then evaluate these rules in light of Gonçalo de Almeida’s theory on the migration of private law to constitutional law, concluding that they reflect
a constitutional intervention aimed at resolving these disputes based on principles such as good faith and the protection of users’ fundamental rights. This approach acknowledges the imbalance in bargaining power between the parties and highlights the insufficiency of private law doctrine in adequately addressing these cases.
