Derechos bioculturales: perspectiva filosófica

Resumen
Los derechos bioculturales se han empleado como fundamento teórico para las declaraciones como sujetos de derecho de los ríos Whanganui (en Nueva Zelanda) y Atrato (en Colombia). La figura teórica de los derechos bioculturales se ha analizado ampliamente desde el derecho; sin embargo, existen aspectos filosóficos que es pertinente estudiar. Este es el caso de las transformaciones ontológicas, epistemológicas y éticas que se vislumbran gracias a la incorporación de las cosmovisiones de las comunidades locales (indígenas y étnicas). En este artículo se busca analizar los aspectos ontológicos, epistemológicos y éticos presentes en los derechos bioculturales y sus precedentes teóricos. La metodología que se emplea es el análisis hermenéutico de textos fundacionales sobre el tema. Además, se ejemplificarán algunos aspectos empleando la Sentencia T622/16 de la Corte Constitucional de Colombia, por la que se declara al río Atrato como sujeto de derechos.
